4. User Accounts
Access to course materials may require the creation of a learner account. By registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials confidential and not share them with any third party.
- Notify us promptly at [email protected] if you suspect any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
Samong may suspend or close accounts that are found to be in breach of these terms without prior notice where the breach is serious.
5. User Responsibilities
We ask all learners to engage with our courses honestly and respectfully. You agree that you will not:
- Share, distribute, resell, or reproduce any course materials without our written permission.
- Submit work that is not your own or misrepresent your participation in assessments.
- Use the Service to develop tools or systems intended to cause harm to individuals or organisations.
- Harass, intimidate, or disrespect other learners or Samong staff in any shared learning spaces.
- Attempt to gain unauthorised access to our systems, content, or other users' accounts.
- Use automated tools to scrape, copy, or collect course content.
- Misrepresent your qualifications, credentials, or identity in any context related to the Service.
Violations of these responsibilities may result in removal from the course without refund.
6. Intellectual Property
All Content provided through the Service — including lesson videos, written materials, code samples, assessments, and exercises — is the intellectual property of Samong or its content partners and is protected under applicable copyright law.
Upon enrolment, you are granted a limited, personal, non-transferable, non-exclusive licence to access and use the course materials solely for your own learning. This licence does not permit you to:
- Copy, reproduce, or distribute materials outside of personal study.
- Create derivative works based on our Content for commercial purposes.
- Sublicence or transfer your access rights to any other party.
Work you produce independently during the course — such as personal portfolio projects built on your own initiative — remains your own. Any feedback or code you submit for mentor review may be used anonymously for teaching purposes unless you request otherwise.
7. Payment Terms
All course fees are quoted in Thai Baht (฿) and are subject to any applicable taxes. Payment is required before course access is granted unless a written instalment arrangement has been agreed in advance.
Refund policy: If you change your mind within seven calendar days of payment — and have not accessed a significant portion of the course materials — you may request a full refund by writing to [email protected]. After this period, or where material access has occurred, refunds are considered on a case-by-case basis at Samong's reasonable discretion.
Samong reserves the right to adjust course pricing. Any price change will not affect fees already paid for an enrolled course.
8. Course-Specific Terms
The following terms apply specifically to learners enrolled in our courses:
- Enrolment: Enrolment is confirmed once payment is received and you have received a confirmation from Samong. Start dates will be communicated at that time.
- Course Duration: Indicative durations are provided for planning purposes. Individual progress may vary depending on the time and effort committed.
- Academic Integrity: Submitted work must reflect your genuine effort. Presenting others' work as your own may result in removal from the programme.
- Completion Records: Where a course includes a completion acknowledgement, this reflects participation and submitted work — it is not a regulated qualification or accreditation under Thai law unless stated otherwise.
- Mentor Availability: Mentor support is offered within the scope described for each course. Response times during public holidays or course breaks may be longer than usual.
9. Disclaimers
The Service is provided in good faith and on an "as is" basis. While we work to maintain accurate and current course content, Samong does not warrant that:
- The Service will be available without interruption at all times.
- Course materials will be free from all errors or that they will meet every learner's specific needs.
- Completion of any course will lead to specific employment outcomes or professional results.
Course content is provided for educational purposes and does not constitute professional advice in any regulated field. We encourage learners to supplement their studies with independent research and, where relevant, seek guidance from qualified practitioners.
10. Limitation of Liability
To the fullest extent permitted by Thai law, Samong's total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid for the specific course from which the claim arises.
Samong shall not be liable for indirect, consequential, incidental, or special damages including but not limited to loss of income, loss of opportunity, or data loss arising from your use of or inability to use the Service.
Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud, or in any other circumstance where liability cannot be lawfully excluded.
11. Indemnification
You agree to indemnify and hold Samong, its mentors, and staff harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these terms, your use of the Service in a manner inconsistent with its intended purpose, or any content you submit or share through the platform that infringes the rights of a third party.
12. Termination
By you: You may withdraw from a course at any time by contacting us. Refunds will be assessed in line with the refund policy in Section 7.
By Samong: We may suspend or end your access to the Service if you breach these terms materially or repeatedly, or if we have reason to believe your conduct is harmful to other learners or to the integrity of the platform. Where possible, we will give prior notice.
Sections covering intellectual property, disclaimers, liability, and dispute resolution will continue to apply after termination of your access.
13. Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Thailand. Any disputes arising under or in connection with these terms shall be subject to the jurisdiction of the Thai courts.
Informal resolution: We would always prefer to resolve concerns informally first. If you have a concern, please reach out to us at [email protected]. We aim to respond within five business days and to work with you towards a fair resolution before any formal steps are taken.
If informal resolution is not possible, either party may pursue the matter through the appropriate Thai court or, where both parties agree, through an accredited mediation service in Thailand.
14. General Provisions
- Entire Agreement: These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Samong regarding the Service.
- Severability: If any provision of these terms is found to be unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full effect.
- Waiver: Samong's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
- Assignment: You may not transfer your rights or obligations under these terms to any third party without our prior written consent. Samong may assign its rights in connection with a merger, acquisition, or sale of assets.
- Notices: Formal notices under these terms should be sent by email to [email protected] or in writing to our registered address.
15. Changes to Terms
We may update these terms from time to time to reflect changes in our Service, applicable law, or business practices. When we do, we will:
- Update the "Last Updated" date at the top of this page.
- Notify currently enrolled learners by email where changes are material.
Continued use of the Service after changes have been communicated constitutes your acceptance of the revised terms. If you do not agree with a material change, you may request to withdraw from your current course and a refund will be considered in accordance with Section 7.
